AMENDED BENGAL TOWNSHIP FIRE ORDINANCE
AN ORDINANCE TO ESTABLISH CHARGES FOR FIRE SERVICES UNDER MICHIGAN PUBLIC ACT 33 OF 1951, AS AMENDED (COMPILED LAW 41.801 ETC.) AND TO PROVIDE METHODS FOR THE COLLECTION OF SUCH CHARGES AND EXEMPTIONS THEREFROM.
THE TOWNHIP OF BENGAL, CLINTON COUNTY, MICHIGAN ORDAINS:
PURPOSE:
This Ordinance is adopted for the purpose of providing financial assistance to the township in the operation of fire protection from those receiving direct benefits from the fire protection service.CHARGES:
The following charges shall hereafter be due and payable to Bengal Township from a recipient of any of the following enumerated services from the Township Fire Protection Contracts. The charge for a fire run of $1,000 for first two hours and $400.00 for each additional hour. Rescue fees of $450.00 for the first hour and $225.00 for each additional hour thereafter. At its discretion the Township may send the bill to the recipients Insurance Company. The fees are subjected to changes.GRACE PERIOD:
All of the foregoing charges shall be due and payable within 30 days from the date of the billing for the service rendered and default of payment shall be collectible through proceedings with the Mid Michigan Collection Bureau of St.Johns, Michigan.JOINT LIABLE:
Where a particular service rendered by the Fire Department directly benefits more than one person or property the owner of each property so benefited shall be liable for the payment of the full charge for such service, herein before outlined.PERSON LIABLE:
The interpretation and application of this ordinance is hereby delegated to the Township Board and shall be administered so that charges shall be collected only from the property of the service.SECTION 6.
Should any provision or part of the within Ordinance be declared by any court or competent jurisdiction to be invalid or unenforceable, the same shall not effect the validity or enforceability of the balance of this Ordinance which shall remain in full force and effect.EFFECT DATE:
This amended ordinance shall take effect immediately. All ordinance or parts of ordinances in conflict herewith are hereby repealed.AMENDED ORDINANCE AND PASSED BY THE BENGAL TOWNSHIP BOARD THE 15TH, DAY OF DECEMBER, 2004.
